These Terms and Conditions (“Terms”) govern the use of the website, services, and products provided by Savage 4x4 Performance and Fabrication, LLC (“Savage 4x4,” “Company,” “we,” “us,” or “our”). By accessing our website, requesting services, authorizing work, or purchasing products, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.
1. Services Savage 4x4 provides automotive performance, fabrication, customization, repair, installation, and related services (“Services”). All Services are subject to availability, scheduling, and acceptance by the Company. We reserve the right to refuse service to any vehicle or customer for any lawful reason, including safety concerns, incomplete information, or non-payment history.
2. Estimates and Authorization Any estimates provided are good-faith estimates only and not guarantees of final cost. Final pricing may vary due to unforeseen conditions, parts availability, vehicle condition, or customer-requested changes. By authorizing Services (verbally, in writing, electronically, or by vehicle drop-off), you approve the work described and agree to pay all associated charges. Additional work required for safety, compliance, or proper completion may be performed with customer approval when feasible.
3. Customer Responsibilities You agree to: Provide accurate vehicle information and disclose known issues or modifications Remove personal belongings from the vehicle prior to service Maintain required insurance coverage on the vehicle Timely approve estimates and pay all amounts due Savage 4x4 is not responsible for loss or damage to personal items left in vehicles.
4. Payments and Fees Payment is due as specified on the invoice, typically upon completion of Services unless otherwise agreed in writing. We accept approved forms of payment as posted or communicated. Late payments may be subject to late fees, interest, or collection costs as permitted by law. Deposits may be required for custom fabrication, special-order parts, or extended projects. All deposits are non-refundable unless otherwise stated in writing.
5. Storage and Abandoned Vehicles Vehicles not picked up within 3 days of service completion may incur storage fees. Vehicles left beyond a reasonable period may be deemed abandoned and handled in accordance with South Carolina law, including lien enforcement or sale.
6. Parts and Materials Customer-supplied parts are installed at the customer’s risk. We do not warranty customer-supplied parts. New, used, aftermarket, or custom-fabricated parts may be used depending on availability and service requirements. Special-order parts are non-refundable once ordered.
7. Warranties and Disclaimers A. Workmanship Warranty We may provide a limited workmanship warranty on labor as specified on your invoice. This warranty does not cover: Normal wear and tear Abuse, misuse, racing, or off-road use beyond intended design Modifications or repairs performed by third parties Failure of non-warranted parts B. Performance Modifications Automotive performance modifications may: Affect vehicle reliability, emissions compliance, fuel economy, or drivability Void manufacturer warranties Be intended for off-road or competition use only Customer assumes all risks associated with performance modifications. C. Disclaimer Except as expressly stated, Services are provided “as is” without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
8. Limitation of Liability To the fullest extent permitted by law: Savage 4x4 shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by the customer for the specific Services giving rise to the claim. We are not responsible for pre-existing vehicle conditions or failures unrelated to our work.
9. Indemnification You agree to indemnify and hold harmless Savage 4x4, its owners, employees, and agents from any claims, damages, losses, or expenses arising from: Your use of the vehicle after Services Performance modifications Third-party claims related to vehicle operation
10. Assumption of Risk You acknowledge that automotive repair, fabrication, and performance modifications involve inherent risks. You voluntarily assume all risks associated with the Services and the operation of the vehicle thereafter.
11. Website Use You agree not to: Use the website for unlawful purposes Attempt to disrupt or damage website functionality Copy or misuse website content without permission All website content is the property of Savage 4x4 and protected by intellectual property laws.
12. Third-Party Products and Services We are not responsible for warranties, failures, or representations of third-party manufacturers, vendors, or service providers.
13. Termination of Services We reserve the right to suspend or terminate Services for non-payment, safety concerns, breach of these Terms, or other lawful reasons.
14. Governing Law and Venue These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in South Carolina.
15. Changes to Terms We may update these Terms at any time. Updated Terms will be posted with a revised Effective Date. Continued use of our Services constitutes acceptance of the updated Terms. 16.
